Welcome to Ishtam, operated by Fall in MalayaLove, LLC ("Company," "Ishtam," "us," or "our"). This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our video dating platform (the "Service").

By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with our policies and practices, please do not use the Service.

1. INFORMATION WE COLLECT

Account Information: When you create an account, we collect your name, email address, date of birth, gender, and password.

1.2 Information We Collect Automatically:

We may receive information about you from third-party services if you choose to link your Ishtam account with other platforms, or from analytics providers, advertising partners, and fraud prevention services.

1.4 SMS/Text Message Information:

When you opt in to receive SMS/text messages from Ishtam, we collect and use your mobile phone number to send you automated text messages regarding your video dating schedule, match notifications, appointment reminders, account security alerts, and Service updates.

What We Collect: We collect your mobile phone number, mobile carrier information, and message delivery status (whether messages were successfully delivered, failed, or bounced).

How We Use It: We use your mobile phone number solely to:

Send you video date match notifications and reminders
Provide account security notifications
Deliver Service-related updates and announcements
Respond to your text message inquiries (HELP, STOP)

Third-Party Sharing: We do not share, sell, rent, or otherwise distribute your mobile phone number to third parties for their marketing purposes. Your mobile phone number is only shared with our SMS service provider as necessary to deliver text messages to you. Our SMS service provider is contractually obligated to protect your information and use it only for message delivery purposes.

Marketing Use: We will not use your mobile phone number for marketing purposes beyond the Ishtam Service communications you consented to receive. You can opt out of text messages at any time by texting STOP.

Data Retention: If you opt out of SMS messages or delete your account, we will stop sending messages immediately and will delete your mobile phone number from our SMS system within 30 days, except as required for legal or regulatory compliance.

2. HOW WE USE YOUR INFORMATION

We use the information we collect for the following purposes:

Provide and Maintain the Service: To create and manage your account, facilitate weekly video date matching, process payments, and provide customer support.
Matching Algorithm: To match you with compatible users based on your preferences and criteria, and to improve the quality and accuracy of our matching algorithm.
Communications: To send you service-related communications, including account notifications, subscription updates, technical notices, customer support responses, and SMS/text message notifications if you have opted in.
Marketing: With your consent, to send you promotional emails, special offers, and information about features or services we think may interest you. You may opt out at any time.
Personalization: To personalize your experience and provide content and features tailored to your interests and preferences.
Safety and Security: To verify accounts, detect and prevent fraud, enforce our Terms of Service, protect against malicious or illegal activity, and ensure the safety of our users.
Analytics and Improvement: To analyze how users interact with the Service, understand trends, measure the effectiveness of our features, and improve the Service.
Legal Compliance: To comply with legal obligations, respond to legal requests, and protect our rights and the rights of others.

3. HOW WE SHARE YOUR INFORMATION

3.1 With Other Users: When you are matched for a video date, your first name and profile photo may be shared with your matched user. Any information you choose to share during a video date is at your discretion.

3.2 Service Providers: We share information with third-party service providers who perform services on our behalf, including payment processing, data analytics, email delivery, hosting services, customer service, fraud detection, video conferencing infrastructure, and SMS/text message delivery. These providers are contractually obligated to protect your information and use it only for the purposes we specify. We do not share your mobile phone number with third parties for their marketing purposes.

3.3 Business Transfers: If we are involved in a merger, acquisition, asset sale, bankruptcy, or other business transaction, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.

3.4 Legal Requirements: We may disclose your information if required by law, regulation, legal process, or governmental request, or if we believe disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a judicial proceeding, court order, or legal process.

3.5 With Your Consent: We may share your information with third parties when you give us explicit consent to do so.

3.6 Aggregated or De-Identified Information: We may share aggregated or de-identified information that cannot reasonably be used to identify you for analytics, research, or other purposes.

4. VIDEO DATE PRIVACY

4.1 No Recording by Ishtam: We do not record, store, or monitor the audio or video content of your video dates. Video dates are conducted in real-time using secure video conferencing technology, and the content is not saved or accessible by Ishtam after the call ends.

4.2 Technical Metadata: We may collect non-content metadata about video sessions, such as connection timestamps, session duration, video quality metrics, and technical error logs. This information is used solely for technical support, service improvement, and quality assurance purposes.

4.3 User Responsibility: Users are prohibited from recording video dates without the explicit consent of all participants. We are not responsible for any unauthorized recordings made by users in violation of our Terms of Service.

5. DATA RETENTION

We retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. Specifically:

Account Information: We retain your account information for as long as your account is active. If you delete your account, we will delete or anonymize your personal information within 90 days, except as required for legal, regulatory, or legitimate business purposes.
Payment Information: Payment transaction records are retained for tax, accounting, and legal compliance purposes, typically for 7 years.
SMS/Text Message Data: If you opt out of SMS messages or delete your account, we will stop sending messages immediately and will delete your mobile phone number from our SMS system within 30 days, except as required for legal or regulatory compliance.
Usage and Analytics Data: We may retain aggregated or de-identified data indefinitely for analytics and research purposes.
Communications: Customer support communications and feedback may be retained for record-keeping and quality assurance purposes.

13. DO NOT TRACK SIGNALS

Some web browsers have a "Do Not Track" feature that signals to websites that you do not want your online activities tracked. Currently, the Service does not respond to Do Not Track signals or similar mechanisms.
